Welcome to Mind Matters. These Terms & Conditions apply to your use of our website and to purchases made through our online store.

By using our website or placing an order with us, you agree to these Terms & Conditions. Please read them carefully before placing an order.

These Terms & Conditions are intended to apply to customers purchasing products for personal use. Nothing in these terms affects your statutory rights under UK consumer law.


1. About Us

Mind Matters is an apparel company focused on promoting mental health awareness through clothing and other products.

2. Our Products

We aim to ensure that all product descriptions, photographs, colours, sizes and other information displayed on our website are accurate.

However, colours may appear slightly different depending on your device or screen settings.

You should check the product description, size information and any other relevant information before placing your order.

All products are subject to availability.


3. Placing an Order

When you place an order through our website, you are making an offer to purchase the products selected by you.

After placing an order, you will receive an order confirmation acknowledging that we have received your order.

Your order will normally be accepted when we send confirmation that your products have been dispatched, unless we notify you otherwise.

We reserve the right to refuse or cancel an order where there is a genuine reason to do so, including where:

  • A product is unavailable;

  • There is an obvious pricing or product description error;

  • We suspect fraudulent or unlawful activity; or

  • We are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will provide a full refund for the cancelled order.


4. Prices

All prices displayed on our website are shown in British pounds (£) unless otherwise stated.

The price payable will be the price displayed at the time you place your order.

Delivery charges will be displayed separately before you complete your purchase.

We take reasonable care to ensure that prices are accurate. If we discover an obvious pricing error before your order is dispatched, we will contact you and give you the option to proceed at the correct price or cancel the order.


5. Payment

We accept the payment methods displayed at checkout.

Payment must be authorised before your order can be processed.

By submitting an order, you confirm that you are authorised to use the payment method provided.

We do not store your complete payment card details where payment is processed through a third-party payment provider.


6. Delivery

We will deliver your order to the delivery address provided at checkout.

Estimated delivery times and delivery charges will be displayed during the ordering process.

We will aim to dispatch and deliver your order within the timeframe stated on our website.

Unless a different delivery period has been agreed with you, goods should generally be delivered without undue delay and no later than 30 days after the contract is entered into, subject to applicable exceptions.

Delivery times may occasionally be affected by circumstances outside our reasonable control, such as postal delays, severe weather or other significant disruptions.

If there is a significant delivery delay, you may have additional rights under UK consumer law.


7. Risk and Ownership

Responsibility for the goods generally passes to you when you, or a person nominated by you, physically receives them.

If you have nominated a carrier to collect the goods and that carrier was not offered by us, responsibility may pass to you when the goods are handed to that carrier.

Ownership of the goods passes to you once we have received full payment for the goods and any applicable delivery charges.


8. Returns and Cancellation

If you purchase products from us online, you generally have a statutory 14-day right to cancel your order under the Consumer Contracts Regulations 2013.

  • Damaged or incorrect products;

  • Exchanges; and

  • Personalised or made-to-order products.

Nothing in our returns policy limits your statutory consumer rights.


9. Faulty or Misdescribed Products

Under the Consumer Rights Act 2015, goods supplied to consumers must generally be:

  • Of satisfactory quality;

  • Fit for purpose; and

  • As described.

If you receive a product that does not meet these requirements, you may have legal rights including a repair, replacement, price reduction or refund depending on the circumstances.

If you believe that a product is faulty or incorrect, please contact us at [your email address] with your order number and details of the problem.

Nothing in these Terms & Conditions limits or excludes rights that cannot legally be excluded.


10. Clothing Sizes and Fit

We provide size information and measurements where available.

Customers are responsible for selecting the appropriate size based on the information provided.

If an item does not fit as expected but is otherwise of satisfactory quality and as described, our standard returns and cancellation terms will apply.


11. Personalised Products

Where Mind Matters offers personalised or made-to-order products, these products may not be subject to the standard 14-day cancellation right where the law permits an exception for goods made to the consumer's specifications or clearly personalised.

This does not affect your statutory rights if the personalised product is faulty, incorrectly made or otherwise does not conform to the contract.


12. Intellectual Property

All intellectual property rights relating to the Mind Matters website, including our branding, logos, graphics, photographs, product designs, text and other original content, belong to Mind Matters or our relevant licensors unless otherwise stated.

You may access and use the website for personal, non-commercial purposes.

You must not reproduce, copy, modify, distribute, sell or commercially exploit our content without our prior written permission.


13. User Content

If you submit photographs, reviews, comments or other content to Mind Matters, you must ensure that you have the necessary rights to provide that content.

You must not submit content that:

  • Is unlawful;

  • Is threatening, abusive or discriminatory;

  • Infringes another person's intellectual property rights;

  • Contains malicious software;

  • Contains another person's personal information without appropriate permission; or

  • Is otherwise inappropriate for our website.

We reserve the right to remove content that breaches these requirements or applicable law.


14. Website Use

You agree not to misuse our website.

You must not attempt to:

  • Gain unauthorised access to our website or systems;

  • Introduce viruses, malware or other harmful material;

  • Interfere with the operation of our website;

  • Faulty products where liability cannot legally be excluded; or

  • Any other liability that cannot legally be excluded or limited.

Subject to the above, we will only be responsible for losses that are reasonably foreseeable and arise as a result of our breach of these Terms & Conditions or our failure to exercise reasonable care and skill.

If you are purchasing products as a consumer, nothing in these Terms & Conditions is intended to remove or restrict protections provided to you by UK consumer law.


17. Events Outside Our Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control.

These may include, for example:

  • Natural disasters;

  • Severe weather;

  • Fire;

  • Flood;

  • Industrial disputes;

  • Government restrictions;

  • Internet or telecommunications failures;

  • Transport disruption; or

  • Major disruption to suppliers or delivery networks.

Where such an event affects your order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

This clause does not remove any statutory rights you may have.


18. Privacy

We collect and use personal information in accordance with our Privacy Policy.

By placing an order, you acknowledge that your personal information will be processed as described in that policy.

We will not use your personal information in a way that is inconsistent with applicable data protection law.


19. Promotions and Discount Codes

From time to time, Mind Matters may offer promotional codes, discounts or other special offers.

Unless otherwise stated:

  • Promotional codes must be entered at checkout;

  • Only one promotional code may be used per order;

  • Promotional codes cannot be exchanged for cash;

  • Promotional offers cannot be applied retrospectively to previous orders; and

  • We reserve the right to withdraw a promotion where there has been an obvious error or where the promotion has ended.

Any specific terms attached to an individual promotion will take precedence over this section.

We may update these Terms & Conditions from time to time.

Any changes will be posted on this page with an updated "Last updated" date.

Changes will not affect orders that you have already placed unless required by law or otherwise agreed with you.

These Terms & Conditions are governed by the laws of England and Wales.

These Terms & Conditions do not affect your statutory rights.
